CozyShelf respects the intellectual property rights of authors, publishers, illustrators, photographers and designers. This page explains how to tell us about material in CozyShelf that you believe infringes your copyright, and what we do when you do.

This policy applies to the CozyShelf mobile applications and to cozyshelf.app (together, the "Service"), operated by an individual sole trader (the "Service Provider").

CozyShelf is a personal reading tracker. It helps readers catalogue books they own or want to read. To do that, it displays book metadata and cover images retrieved from third-party sources, including Google Books, Open Library and Hardcover, and in some cases images supplied by readers themselves.

CozyShelf does not host, sell or distribute books, and does not claim ownership of any cover image, title, description or other material sourced from these third parties. Where material is retrieved from a third-party catalogue, the rights in that material remain with its owner.

Because this material originates outside our control, errors are possible. If something of yours appears in CozyShelf and should not, we want to hear about it and we will act on it.

If you are a copyright owner, or authorised to act on behalf of one, and you believe material available through the Service infringes your copyright, send a written notice to our designated agent at:

Under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), your notice must include all of the following:

1. A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
2. Identification of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
3. Identification of the material you claim is infringing and that you want removed, with enough detail for us to locate it. For CozyShelf this normally means the book title and author, and the image URL if you have it.
4. Your contact details: name, mailing address, telephone number and email address.
5. A statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the owner's behalf.

On receiving a notice that complies with the requirements above, we will act expeditiously to remove or disable access to the material in question. We will make reasonable efforts to notify the person who supplied the material, where one is identifiable, and to tell you what action we have taken.

Where the material was retrieved automatically from a third-party catalogue, removing it from CozyShelf will not remove it from that catalogue. We will tell you which source it came from so you can approach them directly if you wish.

If a notice is incomplete, we will tell you which elements are missing so you can resubmit it.

If your material was removed and you believe this was a mistake, or that you have the right to use it, you may send a counter-notification to hello@cozyshelf.app. Under 17 U.S.C. § 512(g)(3) it must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location where it appeared before removal.
3. A statement, made under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
4. Your name, mailing address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which the Service Provider may be found), and that you will accept service of process from the person who submitted the original notice or their agent.

We will forward your counter-notification to the original complainant. If they do not notify us within ten business days that they have filed a court action seeking to restrain the activity, we may restore the material.

It is our policy, in appropriate circumstances, to disable and where appropriate terminate the accounts of users who are repeat infringers.

The DMCA is United States law. We follow the process described above for all notices, wherever they come from, and we will also act on valid takedown requests made under other applicable law, including the EU Digital Services Act. Use the same email address and give us the same information.
